Prairie Meadow Farms Contract of Sale     The following is an Agreement between Jim and Sandy Townsend, doing business as Prairie Meadow Farms (breeder), hereafter known as “Seller” and __________________________________, hereafter referred to as “Buyer.”   Seller does hereby agree to sell the _______________ dog (puppy named “_______________”) of the Cavalier King Charles Spaniel breed, Sired by __________________________________, AKC Registration # ______________, out of Dam:______________________________, AKC Registration # ________________, whelped on_______________________, and of AKC Litter Registration # ____________________.   Consideration for this sale is $____________.00, to be paid in addition to fulfilling conditions required to be performed by Buyer which are set forth below and in health guarantee attached.   Buyer agrees to pay Seller the first payment of $_________.00 as a Surety of Action deposit and does hereby agree to pay $_________.00 as the balance due Seller before dog is delivered.  Surety of Action deposit is nonrefundable, but may be transferred to another dog being returned or exchanged under the conditions of the attached health guarantee.  Within 30 days of receipt of the full balance due and compliance with the terms of the neuter/spay agreement, Seller will furnish Buyer with the registration papers of the American Kennel Club, of the dog specified in this agreement.   Buyer agrees to take good and reasonable care, providing the dog with a fenced yard or other roomy enclosure; agrees to provide at own expense protective vaccinations as per the instructions with which Seller provided Buyer: agrees to control the dog on a lead when out of protective enclosure; protect the dog in every reasonable and normal way possible against loss through theft, injury, running or other.   The information set forth on this Agreement is declared to be true by all parties.   ____________________________     Date & Time of Signature     ____________________________ Seller (Jim Townsend)     ____________________________     Seller (Sandy Townsend)     ____________________________ Buyer               Prairie Meadow Farms Health Guarantee & Neuter/Spay Agreement     All Cavaliers bred and/or sold by Prairie Meadow Farms will be described as honestly as possible upon being evaluated by our veterinarian.  Seller states that the dog you are purchasing is in good health at the time of the sale.  Seller must be informed of any problem with the dog within three business days of taking possession of the dog.  Buyer agrees to have a reputable veterinarian examine the dog within this time frame to determine the health status of the dog.  If during this initial examination it is determined that the dog has an ailment of a permanent, life-threatening nature, Seller will take the dog back and refund any payments received above the Surety of Action deposit.  In addition, Seller guarantees, for a period up to two years of age, dog against fatal or life altering congenital and genetic diseases.  Seller will exchange the dog with the next available dog of equivalent value.  Seller reserves the rights to have our veterinarian confirm the diagnosis of the Buyer’s veterinarian and to determine if ailment is derived from natural causes before any refund or exchange will be considered.  Any indication of trauma, neglect or abuse will negate any guarantees and Buyer will immediately forfeit possession of the dog without receiving any refund or exchange.  All veterinary and transportation expenses incurred by the Buyer are the sole responsibility of the Buyer.   All of our Cavaliers are accompanied by an accurate, up-to-date medical history from our veterinarian at the Abilene Animal Hospital in Abilene, Kansas.  All inoculations appropriate for the dog’s age have been completed by our veterinarian.  Buyer agrees to complete recommended inoculations, to keep dog out of areas where it would be susceptible to diseases until after its 12-week old vaccinations and to provide the dog with appropriate parasite protection for the Buyer’s area.  Buyer also agrees to provide a high quality diet suitable for Cavaliers, to provide that diet and treats in correct amounts and to provide adequate exercise to keep dog in healthy condition.   Buyer acknowledges that dog is being sold as a companion animal only.  Seller requires that male dogs be neutered by six months of age and female dogs spayed by nine months of age.  Upon neutering, have a statement from Buyer’s veterinarian forwarded to Seller to confirm procedure.   Prairie Meadow Farms is interested in the well being of our Cavaliers for their entire lifetime.  We want to hear about their progress and tidbits from their life.  If for any reason or at any age, the Buyer finds that they are unable or unwilling to keep the Cavalier purchased from Prairie Meadow Farms, we will take it back or help to place it in a new home.  This statement does not imply any funds being returned for the dog.   All parties acknowledge that they have received a copy of both sides of this document.  Furthermore, Buyer accepts the terms and conditions of the guarantee printed on this document and agrees to waive and relinquish any other rights and that no implied or perceived rights exist except those printed in this document.  Buyer acknowledges that he/she has read, understands and agrees to the terms of this document.     ____________________________     Date & Time of Signature     ____________________________ Seller (Jim Townsend)     ____________________________     Seller (Sandy Townsend)     ____________________________ Buyer
